Terms of Service

1. Acceptance of Terms

By accessing or using Smoothly (available at smoothly.dev), including any associated services, features, and content (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Smoothly, operated by Fredrik Ankarskold, sole proprietor, registered in Sweden (“Smoothly,” “we,” “us,” or “our”). By creating an account, subscribing to a plan, or otherwise using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Smoothly is an AI-powered platform that enables users to build applications and websites through natural-language interaction. The Service includes, but is not limited to:

• AI-assisted code generation, editing, and iteration for web applications
• Live preview and sandboxed execution of generated projects
• Hosting and publishing of user projects on smoothly.to subdomains and custom domains
• Asset generation, including AI-powered image creation and editing
• Integrations with third-party services such as Supabase, Stripe, and GitHub
• A template gallery and marketplace for starting points and components

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

3. User Accounts

To use certain features of the Service, you must create an account. Account registration is handled through our authentication provider (Supabase Auth) and supports sign-up via email and password or GitHub OAuth.

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share them with any third party
• Immediately notify us at support@smoothly.dev of any unauthorized access to or use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Subscription & Billing

Smoothly offers subscription plans with a credit-based usage system. All prices are denominated in euros (EUR). Payment processing is handled securely by Stripe.

• Credits: Each subscription plan includes a monthly allocation of credits. Credits are consumed when you use AI-powered features such as code generation, editing, and asset creation. Different actions may consume different amounts of credits.
• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods.
• Price changes: We may change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• Failed payments: If a payment fails, we may provide a grace period during which your account remains active. If payment is not resolved within the grace period, your account may be downgraded or suspended.

5. User Content & Intellectual Property

Your content: You retain full ownership of the websites, applications, code, text, images, and other content you create using the Service (“User Content”). Smoothly does not claim any ownership rights over your User Content.

AI-generated output: Code and content generated by the AI in response to your instructions are considered part of your User Content. You are free to use, modify, distribute, and commercialize AI-generated output without restriction from Smoothly. You acknowledge that AI-generated code may resemble publicly available patterns and that Smoothly does not guarantee the uniqueness or originality of any output.

Platform IP: Smoothly and its licensors retain all rights, title, and interest in and to the Service, including the underlying platform software, AI models, user interface designs, branding, templates (unless explicitly licensed otherwise), and documentation. Nothing in these Terms grants you any right to use Smoothly's trademarks, logos, or branding.

License: By using the Service, you grant Smoothly a limited, non-exclusive, worldwide license to host, store, transmit, and display your User Content solely to the extent necessary to provide and operate the Service (for example, to host your published website on a smoothly.to subdomain).

6. Acceptable Use

You agree not to use the Service to:

• Create, distribute, or host content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Generate content that infringes on intellectual property rights, privacy rights, or other rights of any third party
• Abuse, exploit, or attempt to circumvent the AI system, including prompt injection attacks, jailbreaking, or attempts to extract system prompts or training data
• Circumvent or manipulate the credit system, rate limits, or other usage restrictions
• Create multiple accounts to obtain additional free credits or circumvent account-level limits
• Use automated scripts, bots, or crawlers to access the Service in a manner that places undue load on our infrastructure
• Distribute malware, phishing content, or any code designed to harm users or systems
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account without prior notice.

7. Third-Party Services

The Service relies on and integrates with third-party services to provide its functionality. These include, but are not limited to:

• Vercel — hosting and deployment infrastructure
• Supabase — authentication and database services
• Stripe — payment processing
• Cloudflare — CDN, DNS, and object storage (R2)
• Modal — sandboxed code execution environments
• Anthropic, Google — AI model providers

Your use of the Service may be subject to the terms and policies of these third-party providers. Smoothly is not responsible for the availability, reliability, or practices of third-party services. We encourage you to review the terms of service and privacy policies of any third-party services that you interact with through Smoothly.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Smoothly and its operator, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the cause of action or the theory of liability.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Smoothly's total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to Smoothly in the twelve (12) months immediately preceding the event giving rise to the claim.

Smoothly does not guarantee that AI-generated code or content will be error-free, secure, or fit for any particular purpose. You are solely responsible for reviewing, testing, and validating all output before deploying it to production environments.

9. Termination

By you: You may terminate your account at any time by cancelling your subscription and deleting your account from the account settings page, or by contacting us at support@smoothly.dev.

By us: We may suspend or terminate your account at any time if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. We will provide reasonable notice where possible, except in cases of serious violations of the Acceptable Use policy.

Data export: Upon termination, you will have a 30-day window to export your User Content (including project source code and assets). After this period, we may delete your data in accordance with our data retention policies. Published websites on smoothly.to subdomains will be taken offline upon account termination.

Sections of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property, Limitation of Liability, and Governing Law) shall survive any termination of your account.

10. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email to the address associated with your account or through a prominent notice within the Service. Non-material changes (such as typographical corrections or clarifications) may be made without notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should discontinue use of the Service and terminate your account before the changes take effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sweden.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
